The activity of private detectives in Spain is rigorously regulated. At Octopus Detectives, we operate in strict adherence to the law and a solid ethical code, guaranteeing the validity of our actions and the protection of the rights of all parties.

A Deeper Look at the Regulations
Law 5/2014 on Private Security
This law is the fundamental pillar regulating our profession. It establishes that only private detectives authorised with the Professional Identity Card (TIP) may carry out private investigations. It clearly defines what services we can offer (investigation of private conduct or facts for legitimate purposes) and what is prohibited (offences prosecuted ex officio, use of material or technical means that infringe fundamental rights).
It requires us to cooperate with the Security Forces when our investigations are related to criminal acts or those affecting public safety.
Data Protection (GDPR and LOPDGDD)
The processing of personal data is inherent to our activity. We therefore rigorously apply the General Data Protection Regulation (EU) 2016/679 and the Spanish Organic Law 3/2018 on Data Protection and Digital Rights.
- Legal Basis: We only process data when there is a legal basis, primarily the legitimate interest of the client who contracts us to obtain evidence in the context of legal proceedings or to defend their interests.
- Purpose: Data is collected for specified, explicit and legitimate purposes, and is not further processed in a manner incompatible with those purposes.
- Minimisation: We collect only the data strictly necessary for the commissioned investigation.
- Security: We implement technical and organisational measures to ensure data security (encryption, access control, etc.).
- ARSOPOL Rights: We inform and facilitate the exercise of rights of access, rectification, erasure, objection, portability and restriction of processing.

Ethics and Deontology
Beyond the law, our ethical commitment is fundamental. We act with objectivity, impartiality, honesty and respect. Professional secrecy is inviolable, protecting the confidentiality of our clients and the information obtained. We refuse assignments we consider illegal or ethically reprehensible.
Judicial Validity
Reports issued by authorised private detectives are considered qualified testimony and have full validity as evidence in Spanish courts (civil, labour, commercial, criminal jurisdictions, etc.). We are obliged to ratify our reports in court if required to do so.
